RENEWABLE ENERGIES AND CLIMATE CHANGES, ARE THEY DOING THE RIGHT LAWS?
The beginning of the "European Strategy of Adapting to Climate
Changes" in 2013, has given the will to European Countries for adopting
a national strategy study project.
The National Strategy of Adaptation
to Climate Changes was approved in Italy through the italian Environment Ministry
Decree on June 16, 2015; consequently, the Economic Development Ministry
presented a bill for an Integrated National
Plan of Energy and Climate (PNIEC) at European Commission and, with the
Environment Ministry and the Infrastructures and Transport Ministry, elaborated
together the National Integrated Energy
Plan and Climate 2030 (reference

It’s a great project that starts
from the common desire to reduce climate changes through the disposal of
polluting sources and adoption of renewable energies, except that the
proponents forgot to observe some fundamental law rules that they had to apply
to the project.
Our study begin with the analysis
of:
· Italian Constitution Article No 32: “The
Republic protects health as a fundamental right of the individual and as a
collective interest…”
· Law No 152 of 2006, Article No 13,
paragraph 4, ANNEX VI
- Contents of the Environmental Report
referred to in Article 13 – (annex full of indications, information and
explanations on the environment, including aspects such as biodiversity,
population, human health, flora and fauna, soil, water, air, climatic factors,
material goods, the cultural heritage, including architectural and
archaeological, the landscape);
Comparing the law articles with the
bill that was presented by the Italian Government to the European Union, it is
clear that they have forgotten something important.
The Health and Environment Committee presented, within the terms of the
law, the comments on the Proposal for an Integrated National Plan for Energy
and Climate (PNIEC), highlighting these serious gaps and asking the legislators
to reformulate the proposal ex-new.
The members of the committee asked
themselves the following question:
"When we talk about the Climate
Change Adaptation Strategy, can we forget about protecting the environment,
population, flora and fauna, and cultural heritages? "
During a climate change the
determining factor is pollution; so it is important to implement a
decarbonisation strategy in favor of renewable energies.
It is also important to find tools
that preserve nature (the primary factor for the survival of our planet),
animals, flora and humans.
There are legislative instruments
that give the rules to plan this change, but why politicians and the competent
peoples in the environment, forgotten to consult them?
We have to ask ourselves:
“If we revolutionize the planet with
renewable energy without protecting health (of humans, flora and fauna) what
kind of change are we going to make?”
If these proposals become Law, a
renewable energy (which can be harmful or even dangerous) could be used for
example, because because the Law does not contain the contents for health
protection.
And then who would be responsible
for the damage caused?
• To the Ministries?
• To the Government?
• To public bodies?
• To environmental subjects?
• To environmental associations
recognized by the Ministry of the Environment?
• Is the Proposal for an Integrated
National Plan for Energy and Climate (PNIEC) the same one
they presented to the European Union? If yes, what will the Commission
have answered?

If we think of our past where, until
a few years ago, we used asbestos (a material with prodigious physical and
thermal properties), without knowing that many people died because of the
dangerousness of the asbestos itself shortly after.
This example should be teaching us
to avoid making the same FATAL
mistakes again.
We invite citizens, committees,
associations, companies, anyone who loves and wants to defend health, the
territory, its beauties, the landscape, the drinking water, the DOC products,
the DOP products to reflect on the themes exposed.
It is important to organize and
coordinate various initiatives, be more effective in the actions to be taken
and overcome the few and late public information.
